NOTICE OF REVOCATION OF 30-DAY LEASE TERMINATION NOTICE REQUIREMENT FOR NONPAYMENT OF RENT
Effective immediately, the Montgomery Housing Authority hereby revokes the temporary requirement providing for a thirty (30) day notice of lease termination for nonpayment of rent that was implemented pursuant to HUD Notice PIH 2021-29 and related federal emergency guidance issued during the COVID-19 national emergency.
In accordance with current HUD regulations and the return to pre-2021 federal standards, the Montgomery Housing Authority will resume use of the fourteen (14) day written notice of lease termination for nonpayment of rent for Public Housing residents, consistent with 24 C.F.R. § 966.4(l)(3)(i)(A), unless otherwise required by applicable state or local law.
Accordingly, residents who fail to pay rent as required under the lease agreement may be issued a fourteen (14) day notice of lease termination for nonpayment of rent beginning on the effective date stated above.
All other lease provisions, grievance procedures, and resident rights remain unchanged and in full force and effect.
This action is consistent with HUD’s revocation of the pandemic-era 30-day notification requirement and the return to the pre-2021 federal notice standards for Public Housing Agencies.
